Andererseits überwacht die FMA auch die Einhaltung der gesetzlichen Vorschriften, die Fairness und Transparenz beim Handel mit börsennotierten Wertpapieren (Kapitalmarkt- und Börsenaufsicht); die angemessene Darstellung der mit der Anlage verbundenen Chancen und Risiken (Kapitalmarktprospektaufsicht); die Einhaltung der Grundsätze der guten Governance und der ordnungsgemäßen Beratung eingehalten werden (Conduct und Vertriebsaufsicht Überwachung der Compliance sowie die Einhaltung der Verhaltensregeln); das Verbieten und die Sanktionierung vom unerlaubten Anbieten und Erbringen von Finanzdienstleistungen; sowie die Überwachung dass alle Finanzinstitutionen über die notwendigen Systeme verfügen, um vorbeugend gegen die Geldwäscherei und Terrorismusfinanzierung vorgehen zu können.
